Terms of Service

By accessing or using this website (the “Site”) or any products or services offered through the Site, you (“You” or “User”) agree to be bound by these Terms of Service (“Terms” or “Agreement”) provided by JESSAM Music Studios, LLC (“JESSAM,” “We,” “Us,” or “Our”). These Terms supersede all prior agreements, representations, or understandings, whether written or oral. If You do not agree to these Terms, please do not use the Site or Our services.
1. General
JESSAM Music Studios operates the website https://jessicawestmusicstudios.com and provides private and group instruction in singing, vocal technique, songwriting, piano, guitar, and ukulele through local and online formats. Instruction is provided by qualified mentors for students of all ages.

Vocal & Physical Health Disclaimer
Singing and musical instruction involve physical activity and carry inherent risks, including vocal strain or injury. JESSAM and its mentors are not medical professionals and do not provide medical advice. If You experience pain, discomfort, or injury, You should discontinue activity and consult a qualified medical professional.
No Guarantee of Results
While Our services may help You develop musical skills, JESSAM makes no guarantees regarding specific outcomes, performance level, professional success, or results. Improvement varies by individual, and use of Our services is at Your own discretion and risk.
3. Subscription and Payment Terms
JESSAM provides services through a subscription-based system and reserves lesson time upon receipt of payment. Payments are processed through Stripe and My Music Staff, and by enrolling or submitting payment You agree to their respective terms of service.
All tuition and fees are nonrefundable once charged. Monthly tuition auto-generates and auto-charges on the 1st of each month. Notices of discontinuation must be submitted more than 24 hours prior to invoice generation. Any payment processed before valid notice of discontinuation is nonrefundable.
JESSAM cannot guarantee receipt or processing of late cancellation notices.
4. Studio Policies
Cancellations & Make-Up Credits
- Lessons must be cancelled by the student through their My Music Staff portal at least 48 hours in advance to generate a make-up credit. Instructors cannot cancel or reschedule lessons on behalf of students.
- Make-up credits are subject to availability and must be scheduled by the student through the portal. Credits expire after 30 days or at the end of the current semester (Fall, Spring, or Summer), whichever occurs first. Unused credits are forfeited.
- Tuition packages are based on enrollment, not attendance. Monthly tuition secures a reserved lesson time for the semester regardless of cancellations or absences, except for lessons falling on designated studio holidays.
Tuition, Fees & Payments
- Tuition must be paid in advance to reserve lesson times.
- All students must maintain an active My Music Staff account with valid payment information on file.
- Autopay enrollment is required. JESSAM does not accept cash, checks, or PayPal.
- Tuition does not include books, music, or materials unless otherwise stated.
- Prices, fees, and packages are subject to change at any time.
- A $25 registration fee applies each semester.
- Failed payments incur a $25 fee; late payments may incur additional charges.
- Extra (5th-week) lessons occurring in longer calendar months are billed separately and are not optional.
Studio Courtesy and Attendance
- Students are expected to arrive on time. If a student is more than 15 minutes late without prior notice, the lesson may be marked absent with no obligation to reschedule.
- Students who are ill or contagious must not attend in-person lessons. Online lessons may be offered at instructor discretion.
- Instructor availability is limited to normal business hours. Please allow up to two business days for responses.
Summer Lessons
- Summer lessons operate on a per-lesson basis rather than fixed tuition. Lessons must be cancelled prior to the 1st of the month to avoid charges. Lessons remaining on the calendar after invoices generate are nonrefundable, subject to the 48-hour cancellation policy.
5. Right to Refuse or Terminate Service
JESSAM reserves the right to suspend, deactivate, or terminate any student account or subscription at any time for any reason, including repeated policy violations, non-payment, or disruptive behavior. No refunds will be issued for terminated services.
6. Links to Third-Party Websites
The Site may contain links to third-party websites. JESSAM does not control or endorse these sites and assumes no responsibility for their content, accuracy, or availability. Use of third-party sites is at Your own risk.
7. Intellectual Property
All content on this Site is the property of JESSAM Music Studios, LLC and is protected by copyright and trademark laws. Content may not be reproduced, distributed, or repurposed without written permission.
8. DMCA Policy
JESSAM complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). DMCA notices may be submitted to jessamstudio@gmail.com or mailed to JESSAM Music Studios, LLC, Attn: Copyright Agent, St. George, Utah.
9. Indemnification
You agree to indemnify and hold harmless JESSAM, its mentors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from Your use of the Site or participation in services.
10. Warranty Disclaimer
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” JESSAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT SHALL JESSAM MUSIC STUDIOS, LLC OR IT’S INSTRUCTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT. WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ERRORS OR OMISSIONS IN THE CONTENT PROVIDED THROUGH THIS SITE AND/OR OUR SUBSCRIPTION SERVICES. THE PARTIES AGREE THAT OUR MAXIMUM FINANCIAL OBLIGATION TO YOU IS THE AMOUNT PAID TO US FOR PRODUCTS AND SERVICES PRIOR TO THE DISPUTE.
UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY LOSS OR DAMAGE ALLEGEDLY CAUSED BY YOUR RELIANCE ON ANY INFORMATION PROVIDED ON THIS SITE OR THROUGH OUR PRODUCTS AND SERVICES. YOU ARE RESPONSIBLE FOR EVALUATING THE ACCURACY, APPROPRIATENESS, COMPLETENESS, AND USEFULNESS OF OUR CONTENT AND SERVICES BASED ON YOUR SPECIFIC NEEDS. 13. Communications From Us
When you provide your contact information to us via this Site, You are opting in to receive emails from JESSAM. In accordance with the CAN-SPAM Act, You may opt-out from receiving these communications at any time.
14. Dispute Resolution
By using this Site, You agree that any claim, dispute, or controversy You may have against Us arising out of, relating to, or connected in any way with this Agreement or this Site, shall be resolved exclusively in a court located in Maricopa County, Arizona (where Our lawyers are located). Arizona law shall govern all disputes related to this Site. You agree that You shall only pursue a claim on behalf of Yourself only and shall not seek to file a class action lawsuit.
In all claims, disputes, and controversies related to this Agreement or this Site, the non-prevailing party shall be responsible for the prevailing party’s attorneys’ fees in addition to any damages assessed against them.
If You have a dispute with another user on this Site, that conflict must be resolved between You. We will not get involved unless You are violating this Agreement or disrupting this Site.
15. Miscellaneous
This Agreement shall constitute the entire agreement between the Users and Us with respect to the subject matter in this Agreement. No waiver by either party of any breach or default hereunder is a waiver of any preceding or subsequent breach or default.
The section headings used in this Agreement are for convenience only and shall be of no legal force or effect.
If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in this Agreement, and the remaining portions of this Agreement shall continue in full force and effect. If a provision is found to be invalid, the parties hereby request that the intention of the invalid provision be upheld wherever possible. The failure of either party to exercise any of its rights under this Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided by this Agreement.
16. Termination
We reserve the right to suspend or terminate any User’s subscription at JESSAM at any time and for any reason. Termination may occur without advance notification. JESSAM shall not be liable for any damages for terminating a User.
